I’m syncing…
When we talk about synchronizing or “syncing”, we actually mean the use of existing music in support of new content. Most of the time, it concerns audio visual productions such as TV programs, series, films and TV-commercials. However, some advertisers want that one specific song in their radio commercial or TV ad to boost the image they want to create around their brand. Before using music to this end, you must clear the rights.
Sampling?
“Sampling” is taking a small piece of a song to integrate it into a new song. This requires the permission of the original songwriter (usually represented by a music publisher). When you pick the sample from the original recording, you also need the authorisation of the owner of the recording, namely the record company.
Making a new version?
When you bring an identical version of an existing song (“straight cover”), it suffices to file a declaration with the collective rights society (such as Sabam in Belgium). However, as soon as you make a change to the structure, melody or lyrics of the song, or want to make a translation of it, you will need the permission of the original songwriter, who is usually represented by a music publisher.
